AFFILIATE TERMS AND CONDITIONS

This document is a full disclosure of the Affililate Terms and Conditions for the EGirl Affiliate Program (herein referred as 'the affiliate program') and the software 'EGirl' (herein referred as 'the software'). Any person or party who uses the program is herein referred to as 'the affiliate'.

The affiliate program you agree to be bound by the Terms and Conditions outlined herein.

IF YOU DO NOT AGREE TO THE TERMS OF THE Affiliate Terms and Conditions, THEN DO NOT BECOME AN AFFILIATE.

Affiliate Terms and Conditions

1. Adult-Oriented Content EGirl software, which you will be promoting as a part of the affiliate program, is of adult-oriented nature. Therefore, you assert that you are at least 18 years of age, and that all viewers of your website(s) on which you will be displaying EGirl content are at least 18 years of age. Divergence from this rule will result in affiliate account termination.

2. Display of EGirl content EGirl content and advertisments are available to all affiliates. This content can be displayed only the affilate's network of websites. Unsolicited display by means of spam, spyware, or other forms of subversion are expressly prohibited.

3. Compliance with Local, National, and International Laws You agree to comply with all local, national, international laws and rules which apply to the affiliate program. In addition, US law governs these Affiliate Terms and Conditions and End User Licence Agreement, regardless of the country of residence of the affiliate.

4. Termination These Affiliate Terms and Conditions may be terminated by the affiliate at any time, or by EGirl Interactive, if these terms and conditions are met by the affiliate.

5. Payment amounts and dates EGirl interactive will pay the affiliate $10 for each referral which results in a purchase of EGirl software, constituting half of EGirl Interactive's net profits per unit. The affiliate will be paid bimonthly, on the 1st and 15th of each month.

6. Payment methods EGirl Interactive pays the affiliate by making a direct deposit into the affiliate's checking account. The affiliate must have a checking account in a US bank which allows direct deposits. Under certain circumstances, other forms of payment may be available, at the sole discretion of EGirl Interactive.

7. Limited Liability and Disclaimer of Warranty USE OF THE SOFTWARE AND USE OF THE WEBSITE IS PROVIDED WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS, IMPLIED, OR STATUTORY. THE SOFTWARE AND THE WEBSITE IS PROVIDED BY 'AS IS' AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL EGIRL INTERACTIVE, ITS EMPLOYEES OR BUSINESS ASSOCIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OR OTHER RELIEF (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF, OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AHEAD OF TIME. EGIRL INTERACTIVE MAKES NO WARRANTY THAT THE SOFTWARE OR THE WEBSITE ARE ACCURATE, UNINTERRUPTED OR FREE OF ERRORS; OR THAT USE OF THE SOFTWARE OR WEBSITE WILL MEET YOUR EXPECTATIONS. IN NO EVENT WILL EGIRL INTERACTIVE, ITS EMPLOYEES OR BUSINESS ASSOCIATES MAXIMUM CUMULATIVE LIABILITY UNDER THE Affiliate Terms and Conditions EXCEED ONE DOLLAR ($1.00). THIS DISCLAIMER OF WARRANTY APPLIES TO, AND IS AN ESSENTIAL PART OF THE Affiliate Terms and Conditions.
